EU AI Act: Now in Effect

The EU AI Act has been in full effect since August 2026 for most AI systems. If you have users in the EU, you must comply. Here is a comprehensive checklist.

Step 1: Risk Classification

The EU AI Act classifies AI systems into four risk tiers:

Unacceptable Risk (Prohibited) - Real-time remote biometric identification in public spaces (with narrow exceptions) - Social scoring by governments - AI that exploits vulnerable groups - Subliminal manipulation

If your AI does any of the above: stop immediately.

High Risk (Annex III) High-risk AI includes systems used in: - Biometric identification - Critical infrastructure - Education and vocational training - Employment (hiring, promotion, termination) - Essential services (healthcare, banking, insurance) - Law enforcement - Migration and border control - Administration of justice

If you're in these categories: You need conformity assessments, mandatory registration in the EU AI database, and significantly more documentation.

Limited Risk (Article 52) Chatbots and AI-generated content must disclose they are AI.

Minimal Risk Most AI falls here. Voluntary adherence to codes of practice is encouraged.

Step 2: Mandatory Documentation Checklist

For all AI systems sold/deployed in the EU:

  • **Technical documentation** (Article 11) — system description, purpose, capabilities, limitations
  • **Instructions for use** — clear documentation for deployers/users
  • **AI transparency notice** — inform users they're interacting with AI (Article 52)
  • **Privacy policy update** — GDPR Article 22 for automated decision-making
  • **Data governance documentation** — data sources, training data quality measures

For high-risk AI systems (Annex III), additional requirements:

  • **Risk management system** — documented risk identification and mitigation
  • **Data governance policy** — training/validation/test data documentation
  • **Quality management system** — ongoing monitoring framework
  • **Human oversight measures** — documented oversight mechanisms
  • **Conformity assessment** — Article 43 (self-assessment or third-party)
  • **EU Declaration of Conformity** — Article 47
  • **CE Marking** (where applicable)
  • **Registration in EU AI database** (by August 2026 for new systems)

Step 3: Transparency Obligations (Article 52)

The following must always be disclosed:

1. Chatbots: Users must know they're talking to AI 2. Emotion recognition systems: Subjects must be informed 3. Biometric categorization: Explicit disclosure required 4. AI-generated content: Deep fakes must be labeled; synthetic content clearly marked

Step 4: Governance Structure

  • Designate an **AI System Operator** responsible for compliance
  • Create a **post-market monitoring plan** for high-risk systems
  • Establish an **incident reporting mechanism**
  • Set up documentation retention (10 years for high-risk)

1. Treating the EU AI Act like GDPR: AI Act compliance is separate from GDPR — you need both 2.
